ORDER 14 UNITED STATES OF AMERICA, 15 Defendant. 16 17 Plaintiff Gagan Bhatia commended this action through counsel on November 15, 2019. 18 (ECF No. 1.) On January 21, 2020, defendant United States of America (“United States”) filed 19 an answer. (ECF No. 5.) On August 24, 2023, defendant United States filed a motion for leave 20 to serve a deposition subpoena via alternative means on Harinder Bhatia. (ECF No. 31.) The 21 motion is before the undersigned pursuant to Local Rule 302(c)(1).1 22 Defendant’s motion explains that “Harinder Bhatia’s deposition is vital to the claims and 23 counterclaims of the parties” to this action. (Def.’s Mot. (ECF No. 31) at 3.) Despite eight prior 24 attempts, the United States has been unable to personally serve Harinder Bhatia. (Id. at 2.) 25 Counsel for plaintiff does not oppose the motion. (Id.) 26
