Pending before the Court is Defendant’s motion for summary judgment, ECF 19 No. 65. Plaintiff filed an opposition to Defendant’s motion for summary judgment, ECF No. 69. 20 Defendant filed a reply to Plaintiff’s opposition, ECF No. 70. 21 The Federal Rules of Civil Procedure provide for summary judgment or summary 22 adjudication when “the pleadings, depositions, answers to interrogatories, and admissions on file, 23 together with affidavits, if any, show that there is no genuine issue as to any material fact and that 24 the moving party is entitled to a judgment as a matter of law.” Fed.
