(ECF No. 30.) Plaintiff filed this motion on October 17, 2023, and set the motion for a December 5, 2023, hearing. (Id.) On November 15, 2023, court vacated the motion hearing and took the matter under submission pursuant to Local Rule 230(g). (ECF No. 32.) To date, defendant has not opposed plaintiff’s motion or otherwise made appearances in this action. For the reasons set forth below, the court DENIES plaintiff’s motion without prejudice. I.
