Plaintiff filed this motion on October 17, 2023, and set the motion for a December 20 5, 2023, hearing. (Id.) On November 15, 2023, court vacated the motion hearing and took the 21 matter under submission pursuant to Local Rule 230(g). (ECF No. 32.) To date, defendant has 22 not opposed plaintiff’s motion or otherwise made appearances in this action. 23 For the reasons set forth below, the court DENIES plaintiff’s motion without prejudice. 24 I.
