In response, Plaintiff filed a Motion directing the 22 Clerk of Court to disregard the MSJ because it was filed prematurely and not in compliance with 23 the Court’s Discovery and Scheduling Order (“DSO”). (Doc. No. 38, “Plaintiff’s Motion”).
