16 On December 11, 2023, Attorney Jonathan Pena, counsel for Plaintiff Jou Vang, filed a motion for an award of attorney’s fees under the Equal Access to Justice Act (EAJA), 28 U.S.C. § 2412(d). (ECF No. 24). Plaintiff and the Commissioner of Social Security were each served with a copy of the motion. (ECF No. 27; ECF No. 24 at 7-8). On February 22, 2024, the Commissioner filed a statement of non-opposition to Plaintiff’s motion, stating that “Defendant does not oppose Plaintiff’s motion for attorney fees under the Equal Access to Justice Act[.]”.
