16 17 On December 11, 2023, Attorney Jonathan Pena, counsel for Plaintiff Jou Vang, filed a 18 motion for an award of attorney’s fees under the Equal Access to Justice Act (EAJA), 28 U.S.C. § 19 2412(d). (ECF No. 24). Plaintiff and the Commissioner of Social Security were each served with 20 a copy of the motion. (ECF No. 27; ECF No. 24 at 7-8). On February 22, 2024, the Commissioner 21 filed a statement of non-opposition to Plaintiff’s motion, stating that “Defendant does not oppose 22 Plaintiff’s motion for attorney fees under the Equal Access to Justice Act[.]”.
