17 Plaintiff is proceeding pro se and in forma pauperis in this action filed pursuant to 42 18

U.S.C. § 1983.

19 Plaintiff’s complaint in this action was filed on August 21, 2023. (ECF No. 1.) 20 On January 12, 2024, the Court screened the complaint, found that Plaintiff failed to state a 21 cognizable claim for relief, and granted Plaintiff thirty days to file an amended complaint. (ECF 22 No. 5.) Plaintiff failed to file an amended complaint or otherwise respond to the January 12, 2024 23 order.
