14 RYAN WAKEFIELD, et al., 15 Defendants. 16 17 By order filed January 11, 2024, the complaint was screened and the undersigned found 18 that plaintiff had failed to request relief that could be granted in a § 1983 action and had failed to 19 state a claim for relief against defendant Hernandez. ECF No. 5. Plaintiff was given thirty days 20 to file an amended complaint, and was cautioned that failure to do so would result in a 21 recommendation that this action be dismissed. Id. at 6. Thirty days have now passed, and 22 plaintiff has not filed an amended complaint or otherwise responded to the court’s order. 23 Although it appears from the file that plaintiff’s copy of the order was returned, plaintiff 24 was properly served.
