MATTESON, et al., 15 Defendants. 16 17 Plaintiff is a state prisoner proceeding in forma pauperis and without counsel in an action 18 brought under 42 U.S.C. § 1983. On September 20, 2023, the court dismissed plaintiff’s 19 complaint with leave to amend. ECF No. 8. Plaintiff has filed an amended complaint which is 20 before the court for screening. ECF No. 11. 21 I. The Amended Complaint 22 Federal courts must engage in a preliminary screening of cases in which prisoners seek 23 redress from a governmental entity or officer or employee of a governmental entity. 28 U.S.C. § 24 1915A(a). The court must identify cognizable claims or dismiss the complaint, or any portion of 25 the complaint, if the complaint “is frivolous, malicious, or fails to state a claim upon which relief 26 may be granted,” or “seeks monetary relief from a defendant who is immune from such relief.”…
