The motion presently before the court is filed by defendants Adams, Andaluz, Ashe, 19 Asman, Branman, Brizendine, Brockenborogh, Ceballos, Heatley, J. Johnson, R. Johnson, 20 Ponciano, Ramkumar, Rekart, Robinson, Rudas, M. Smith, C. Smith, Tebrock, Toche, and 21 Waine. (ECF No. 346.) The moving defendants seek to compel third party Joseph Schmitz, M.D., 22 to comply with a subpoena for production of documents. 23 This matter is appropriate for decision without oral argument.
