Nos. 28, 30) 16 17 This matter came before the court on October 17, 2023 for a hearing on defendant’s 18 motion to dismiss plaintiff’s second amended complaint pursuant to Rule 12(b)(1) and 12(b)(6) of 19 the Federal Rules of Civil Procedure. (Doc. No. 28.) Attorney Bethany Onishenko appeared by 20 video on behalf of plaintiff. Deputy Attorney General Nimrod Elias appeared by video on behalf 21 of defendant.
