Plaintiff 16 filed the instant action on January 26, 2024. 17 On January 29, 2024, the Court ordered Plaintiff to pay the $405.00 filing fee or submit an 18 application to proceed in forma pauperis within forty-five days. (ECF No. 3.) Plaintiff has failed 19 to comply with the Court’s order and the time to do so has passed.
