14 DR. MOHYUDDIN, 15 Defendant. 16 17 On December 29, 2023, defendant filed an amended notice of plaintiff Frank Green’s 18 death. (ECF No. 23.) Pursuant to Federal Rule of Civil Procedure 25, a motion for substitution 19 of a proper party must be made no later than ninety days after the death is suggested upon the 20 record. That time period has now expired, and no motion for substitution has been filed. 21 Accordingly, IT IS HEREBY ORDERED that the Clerk of the Court shall assign a district 22 judge to this action; and 23 IT IS HEREBY RECOMMENDED that this action be dismissed. 24 These findings and recommendations are submitted to the United States District Judge 25 assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l).
