BACKGROUND
21 Plaintiff Thomas L. Goff, currently a state prisoner appearing pro se, initiated this action 22 under 42 U.S.C. § 1983. Doc. 1. On April 23, 2021, Plaintiff’s case was dismissed for failure to 23 prosecute due to Plaintiff’s failure to pay the required filing fee after the Court revoked his in 24 forma pauperis status. See docket. Plaintiff appealed the Court’s order and on December 14, 25
