14 DAVID HICKS, et al., (ECF No. 163) 15 Defendants. 16 17 Plaintiff, a state prisoner proceeding pro se, has filed this civil rights action seeking relief 18 under 42 U.S.C. § 1983. The matter was referred to a United States Magistrate Judge pursuant to 19 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. This case is at the dispositive motion stage of the 20 proceedings. See ECF Nos. 132, 138, 141 (Defendants’ motion for summary judgment; 21 Plaintiff’s response; Defendants’ reply). 22 Plaintiff has filed a motion (ECF No 163) which asks the Court to retract and/or correct its 23 statement in its order issued March 11, 2024, that Plaintiff had been housed in a sensitive needs 24 yard.
