15 Defendants. 28, 2024 16 17 Plaintiff, a state prisoner proceeding pro se and in forma pauperis, has filed this civil 18 rights action seeking relief under 42 U.S.C. § 1983. The matter was referred to a United States 19 Magistrate Judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. This matter is at the 20 dispositive motion phase of the proceedings. 21 Before this Court is Defendants’ motion to dismiss this case. ECF No. 96. The matter is 22 fully briefed. See ECF Nos. 99, 100 (Plaintiff’s opposition; Defendants’ reply, respectively). 23 For the reasons stated below, the Court will decline to rule on Defendants’ motion to 24 dismiss at this time.
