The matter was referred to a United States 19 Magistrate Judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. This matter is at the 20 dispositive motion phase of the proceedings. 21 Before this Court is Defendants’ motion to dismiss this case. ECF No. 96. The matter is 22 fully briefed.
