However, plaintiff is a “Three-Striker” within the meaning of Title 28 U.S.C. 20 §1915(g). See Miller v. Montgomery, 2:23-cv-00100-TLN-EFB (PC) (designating plaintiff as a 21 “three-striker”). Accordingly, on February 6, 2024, I recommended that plaintiff’s application to 22 proceed in forma pauperis be denied. ECF No. 9. Plaintiff was permitted fourteen days to file 23 objections. Id. at 3. I also recommended that plaintiff be directed to tender the filing fee within 24 thirty days of any order adopting my recommendations. Id. Plaintiff did not file objections.
