12 Defendants. 13 14 Plaintiff Susan Abbassi (“Plaintiff”) initiated this action with the filing of a complaint 15 against Defendants Eric Gaudiosi and Antony Blinken (“Defendants”) on November 7, 2023. 16 (Doc. 1). Plaintiff’s action seeks to compel Defendants to act on and adjudicate her fiancé’s filed 17 I-129F visa application. (Doc. 1 ⁋1). 18 Pending before the Court is Defendants’ motion to dismiss or in the alternative for 19 summary judgment, filed January 12, 2024. (Doc. 9). Plaintiff filed an opposition on January 26, 20 2024, and Defendants filed a reply on February 5, 2024. (Docs. 11, 14). For the reasons set forth 21 below, Defendants’ motion to dismiss will be granted. 22 I. Background. 23 A.
