15 Respondent. 16 17 Petitioner is a state prisoner proceeding pro se. On April 8, 2024, petitioner filed a new 18 action using the court’s petition for writ of habeas corpus form. (ECF No. 1.) On April 29, 2024, 19 petitioner was ordered to file an in forma pauperis affidavit or pay the required filing fee. See 20 28 U.S.C. §§ 1914(a); 1915(a). On April 29, 2024, petitioner filed an application to proceed in 21 forma pauperis. 22 Examination of the in forma pauperis application reveals that petitioner is unable to afford 23 the costs of suit. Accordingly, the application to proceed in forma pauperis is granted. See 28 24 U.S.C. § 1915(a). 25 For the reasons set forth below, the Court recommends that this action be dismissed. 26 Discussion 27 As a general rule, a claim that challenges the fact or duration of a…
