14 15 On February 12, 2024, the Court ordered the parties to file a joint scheduling report at 16 least one week in advance of the scheduling conference, set for May 13, 2024 See (“Order 17 Setting Mandatory Scheduling Conference,” Doc. 6). 18 On May 7, 2024, Defendant filed a scheduling report to which Plaintiff was not a party. 19 (Doc. 11). Aside from Defendant’s representation in the report that it “has been unable to” 20 discuss settlement with Plaintiff prior to filing the report, it is unclear to the Court whether 21 Defendant communicated or attempted to communicate with Plaintiff in connection with 22 preparing a joint report – an obligation reasonably implied in the Court’s direction that the…
