ORDER 14 STATE OF CALIFORNIA, et al., 15 Defendants. 16 17 Plaintiff Jeffrey Todd Eastman proceeds without counsel and seeks relief under 42 U.S.C. 18 § 1983. This matter was referred to the undersigned by Local Rule 302. See 28 U.S.C. § 19 636(b)(1). Plaintiff’s complaint and motion to proceed in forma pauperis are before the court. For 20 the reasons set forth below, the complaint fails to state a claim, but plaintiff is granted leave to 21 file an amended complaint within 30 days of the date of this order. 22 I. In Forma Pauperis 23 Plaintiff seeks to proceed in forma pauperis. (ECF No. 2.) The declaration makes the 24 showing required by 28 U.S.C. § 1915(a). The motion is granted. By separate order, plaintiff will 25 be assessed an initial partial filing fee in accordance with the provisions of 28 U.S.C. § 26 1915(b)(1).
