20 21 Plaintiff Bobby Dewayne Felder alleges that defendants Brewer and Steffensmeier used 22 excessive force against him in violation of the Eighth Amendment. Defendants move for 23 summary judgment, arguing that plaintiff’s claims are barred by the favorable termination rule. 24 ECF No. 28. Plaintiff filed a statement of non-opposition, ECF No. 29, and defendants have not 25 filed a reply. I recommend granting defendants’ motion. 26
