GARLAND, et al., 15 Defendants. 16 17 On January 8, 2024, Plaintiff filed this action alleging violations pursuant to the 18 Administrative Procedure Act (“APA”), 5 U.S.C. § 706; the Mandamus Act, 28 U.S.C. § 1361; 19 and the Declaratory Judgment Act, 28 U.S.C. § 2201. (See generally ECF No. 1.) On March 14, 20 2024, Defendants filed a motion to dismiss pursuant to Rule 12(b)(1) of the Federal Rules of Civil 21 Procedure. (ECF No. 7.) On April 3, 2024, the Court issued Findings and Recommendations 22 recommending Defendant’s unopposed motion to dismiss be granted and this action be dismissed 23 as moot. (ECF No. 9.) On April 12, 2024, Plaintiff filed a Notice of Voluntary Dismissal pursuant 24 to Rule 41(a)(1).
