16 17 On May 6, 2024, Attorney Jonathan Pena, counsel for Plaintiff Robyn Lynn Gracey, filed 18 a motion for an award of attorney’s fees under the Equal Access to Justice Act (EAJA), 28 U.S.C. 19 § 2412(d). (ECF No. 24). On May 7, 2024, the Commissioner filed a response to Plaintiff’s 20 motion, stating that “[t]he Commissioner has given substantive consideration to the merits of 21 Plaintiff’s request and found no basis to object.” (ECF No. 15 at 1). 22 I.
