This action proceeds on the first amended complaint (“FAC”) filed August 18, 2023. (ECF No. 9.) Two defendants, Farhan and John Malik (“Malik defendants”), also proceeding pro se, have filed a motion to dismiss the FAC. (ECF No. 14.) Plaintiff has filed an opposition, and the Malik defendants have replied. (ECF Nos. 20 & 28.) This motion is presently before the court. Additionally, defendants Wells Fargo and Robin Arias (“Wells Fargo defendants”) have filed a motion to compel arbitration and stay these proceedings or, alternatively, to dismiss this action.
