17 Plaintiff Elias Serda Diaz (“Plaintiff”), a state prisoner proceeding pro se and in forma pauperis, filed this civil rights action pursuant to 42 U.S.C. § 1983 on August 8, 2023. (ECF No. 1.) The matter was transferred to this Court on August 30, 2023, and assigned to the undersigned on September 14, 2023. (ECF Nos. 4, 5, 9.) Plaintiff filed a first amended complaint on October 23, 2023.
