14 C. PFEIFFER, et al., 2024 15 Defendants. 16 17 Plaintiff, a state prisoner proceeding pro se and in forma pauperis, has filed this civil 18 rights action seeking relief under 42 U.S.C. § 1983. The matter was referred to a United States 19 Magistrate Judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. 20 On April 9, 2024, Plaintiff’s complaint was screened and the Court found that it failed to 21 state a claim upon which relief could be granted. ECF No. 12 at pg 14. As a result, Plaintiff was 22 ordered to file a first amended complaint and was given thirty days to do so. Id. At that time, 23 Plaintiff was also cautioned that his failure to fully comply with the order within the time allotted 24 might result in a recommendation that this matter be dismissed.
