16 The factual background of this matter has been set out in several prior substantive orders 17 and will not be recounted here. Now pending is a motion by plaintiff to dismiss the counterclaims, 18 and two motions by defendants seeking to enjoin plaintiff from pursuing other litigation arising 19 from this dispute.
