12 Defendant. 13 14 Plaintiff, Miguel Carlos Patricio, seeks judicial review of an administrative law judge 15 (“ALJ”) decision denying his application for benefits under Title XVI of the Social Security Act. 16 Plaintiff’s request for review of the ALJ’s unfavorable decision was denied by the Appeals 17 Council, thus, the ALJ’s decision is the “final decision” of the Commissioner of Social Security, 18 which this court may review. See 42 U.S.C. §§ 405(g), 1383(c)(3). Both parties have consented to 19 the jurisdiction of a magistrate judge (dkts. 3 & 12), and both parties have moved for summary 20 judgment (dkts. 22, 23 & 34).1 For the reasons stated below, the court will grant Plaintiff’s 21 amended motion for summary judgment and will deny Defendant’s…
