12 13 Plaintiff Howard L. Johnson seeks judicial review, pursuant to 42 U.S.C. § 405(g), of the 14 Commissioner’s final decision, and the remand of this case for further proceedings. Pending 15 before the Court is Plaintiff’s motion for summary judgment and Defendant’s cross-motion for 16 summary judgment. Having considered the papers filed by the parties, and for the reasons set 17 forth below, the Court DENIES Plaintiff’s motion for summary judgment, and GRANTS 18 Defendant’s cross-motion for summary judgment. 19 I.
