Nos. 27, 31 11 12 Plaintiff Monique Williams brings this tort action against the City of Richmond (the 13 “City”) alleging negligence for dangerous condition of public property arising from a train 14 collision. (Dkt. No. 1-1 (“Compl.”) ¶¶ 48-54.)1 Specifically, plaintiff alleges the City negligently 15 caused a train collision that struck the plaintiff on the train tracks by failing to warn pedestrians adequately of the dangerous conditions or take due care to prevent collisions in an area popular for 16 pedestrian crossings, including by failure to post appropriate warnings via signage or erect barriers 17 to limit pedestrian access.
