INTRODUCTION 14 In this civil rights case brought under 42 U.S.C. § 1983, Plaintiff Marty Palmer alleges the 15 County of Alameda and its employees were deliberately indifferent to his medical condition while 16 incarcerated at Santa Rita Jail. The County and its Sheriff, Gregory Ahern (the “Moving 17 Defendants”), move for dismissal pursuant to Federal Rule of Civil Procedure (“Rule”) 12(b)(6). 18 ECF No. 16. Palmer filed an Opposition (ECF No. 19) and Moving Defendants filed a Reply 19 (ECF No. 20). The Court finds this matter suitable for disposition without oral argument and 20 VACATES the November 7, 2019 hearing. See Civ. L.R. 7-1(b).
