10 SurvJustice, Inc., Equal Rights Advocates, and Victim Rights Law Center (“Plaintiffs”) are 11 non-profit advocacy organizations who sue for injunctive relief against the U.S. Department of 12 Education (the “Department”), Secretary Elisabeth D. DeVos, and Acting Assistant Secretary for 13 Civil Rights Kenneth L. Marcus (collectively, “Defendants”).1 Plaintiffs seek to vacate the 14 Department’s policy regarding enforcement of Title IX of the Education Amendments of 1972 set 15 forth in guidance documents the Department issued on September 22, 2017. (Dkt. No. 123 at ¶ 16 1.)2 Now before the Court are the parties’ cross motions for summary judgment. (Dkt. Nos. 136 17 & 140.)
