13 On October 17, 2019, the Court heard argument on the motion by defendant Keurig Dr. Pepper, Inc. (“Keurig”) to dismiss this action with prejudice. Based on the papers submitted and arguments made, the Court hereby GRANTS the motion to dismiss, with leave to amend. 17 BACKGROUND Defendant Keurig owns a variety of beverage families, including Peñafiel water, which is advertised and labeled as “mineral spring water,” the product at issue in this case.
