14 Matthew J. Capanis filed this pro se action for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. His petition is now before the court for review pursuant to 28 U.S.C. § 2243 and Rule 4 of the Rules Governing Section 2254 Cases in the United States District Courts. His several miscellaneous requests also are before the court for consideration. 19 BACKGROUND The petition provides this information: Following a jury trial in 2017 in Contra Costa County Superior Court, Capanis was convicted of first degree murder and active participation in a criminal street gang, and sentence enhancement allegations were found true.
