11 Defendant. 12 13 14 Pending before the Court is Defendant iTouchless Housewares and Products, Inc.’s motion 15 to dismiss Plaintiff simplehuman, LLC’s design patent infringement claims stated in the amended 16 complaint. Dkt No. 24 (“Mot.”). The Court finds this matter appropriate for disposition without 17 oral argument and the matter is deemed submitted. See Civil L.R. 7-1(b). After carefully 18 reviewing and considering the parties’ arguments, the Court DENIES Defendant’s motion to 19 dismiss. 20 I.
