12 13 14 Plaintiff Marcus Crawley has filed suit against the City of Oakland (“City”).1 Currently 15 pending before the Court is the City’s motion to dismiss and Mr. Crawley’s related motion to 16 strike. Having considered the parties’ briefs and accompanying submissions, the Court finds the 17 motions suitable for disposition without oral argument and thus VACATES the hearing on the 18 motion. The Court hereby GRANTS the motion to dismiss and DENIES in part the motion to 19 strike. 20 I.
