12 13 Plaintiff Marcus Crawley has filed suit against the City of Oakland (“City”). Currently pending before the Court is the City’s motion to dismiss and Mr. Crawley’s related motion to strike. Having considered the parties’ briefs and accompanying submissions, the Court finds the motions suitable for disposition without oral argument and thus VACATES the hearing on the motion. The Court hereby GRANTS the motion to dismiss and DENIES in part the motion to strike. I.
