Harmony City, Inc. (“Plaintiff”) must submit its request for documents located in China in accordance with the procedures proscribed by the Hague Convention on the Taking of Evidence Abroad in Civil or Commercial Matters (“Hague Convention”). Plaintiff argues that Defendant must provide documents pursuant to the Federal Rules of Civil Procedure and that the Hague Convention does not apply here.1 The Court may regulate the conduct of discovery and require the use of the Hague Convention procedures.
