9 Petitioner, a state prisoner proceeding pro se, filed a federal petition for writ of habeas 10 corpus, pursuant to 28 U.S.C. § 2254. Petitioner has filed a motion to declare Respondent in 11 default for failure to answer his petition in the time provided, which the Court construes as a 12 motion requesting the entry of default judgment against Respondent. Dkt. 17. Specifically, 13 Petitioner argues that Respondent failed to file her answer or motion to dismiss by September 23, 14 2019 as ordered by the Court in its July 24, 2019 order to show cause. 15 However, Respondent did file an untimely motion to dismiss on October 13, 2019.
