12 13 On February 1, 2018, Plaintiff Gerald Len Cooley filed this action alleging that his civil 14 rights were violated in connection with an investigation for murder in which he was a suspected 15 accessory. On October 7, 2019, Plaintiff filed a motion for sanctions for spoliation of evidence 16 and requested that the Court enter default judgment against current Defendants Greg Leonard and 17 William Jeha. 18 On November 21, 2019, the Court held a hearing, and after careful consideration of the 19 parties’ arguments and moving papers, and for the reasons set forth below, the Court DENIES 20 WITHOUT PREJUDICE Plaintiff’s motion for sanctions. 21 I.
