13 Defendants County of Santa Clara and Bruce Wagstaff seek summary judgment for 14 Plaintiff Don Moody’s remaining substantive due process claim. They argue that, as a matter of 15 law and based on undisputed material facts, Plaintiff cannot make a showing sufficient to establish 16 the essential elements of his claim. The Court finds this motion suitable for consideration without 17 oral argument. See N.D. Cal. Civ. L.R. 7-1(b).
