Warner, seeking to rescind a professional liability insurance policy issued to Defendants. (Compl. ¶¶ 1-2, Dkt. No. 1.) On October 7, 2019, Defendants filed the pending motion to dismiss the complaint. (Defs.’ Mot. to Dismiss, Dkt. No. 13.) The Court deems the matter suitable for disposition without hearing pursuant to Civil Local Rule 7-1(b), and VACATES the December 5, 2019 hearing.
