11 LANDSCAPE ARCHITECTURE, D.P.C., et al., 12 Defendants. 13 14 Before the Court is plaintiff’s motion to strike the counterclaim asserted by defendants 15 Langan Engineering, Environmental, Surveying and Landscape Architecture, D.P.C. and Langan 16 Engineering and Environmental Services, Inc. (collectively “Langan”). Pursuant to Civil Local Rule 17 7-1(b), the Court finds this matter appropriate for resolution without oral argument and VACATES 18 the December 6, 2019 hearing. 19 20 BACKGROUND 21 The parties’ dispute stems from four excess insurance policies – the 2014, 2015, 2016, and 22 2017 policies, respectively – that Langan took out from plaintiff RLI Insurance Company (“RLI”). 23 Dkt.
