12 In this case five current or former San Francisco Unified School District (SFUSD) students 13 sue SFUSD and its Superintendent Vincent Matthews for systemic violations and failures to 14 provide students “with disabilities with a non-discriminatory and free appropriate public 15 education” (FAPE) in violation of the Individuals with Disabilities Education Act (IDEA), Section 16 504 of the Rehabilitation Act of 1973 (Section 504), and the Americans with Disabilities Act of 17 1990 (ADA). First Amended Complaint [Dkt. No. 34] (“FAC”) ¶ 1. They do not challenge 18 official policies of SFUSD; instead, they challenge alleged practices of SFUSD that result in 19 SFUSD failing to meet its responsibilities under the IDEA.
