INTRODUCTION Before the Court is Defendant’s Motion (Dkt No. 97) for the Court to certify for interlocutory review its January 16, 2020 Order granting in part and denying in part Defendant’s Amended Motion to Dismiss (Dkt No. 93). Plaintiff filed an Opposition to the Motion (Dkt No. 100) and Defendant a Reply (Dkt No. 101). The Court finds this matter suitable for disposition without oral argument and VACATES the March 12, 2020 hearing. See Civ. L.R. 7-1(b). For the reasons set forth below, the Court GRANTS Defendant’s Motion. II.
