I. INTRODUCTION Plaintiff Bobbie Allen Woods, pro se, brought this action against Defendants the City of Hayward, the Hayward Police Department, Hayward Police Officer B. Tong, and Hayward Police Sergeant Polar1 asserting claims based on a police search of Woods’s home pursuant to a warrant. On a previous motion to dismiss Woods’s original complaint, the Court allowed Woods’s claim under the Americans with Disabilities Act to proceed, but dismissed his remaining claims, largely with leave to amend. Woods filed an amended complaint and Defendants move once again to dismiss. The Court held a hearing on February 28, 2020.
