12 13 I. INTRODUCTION Phillip Toretto (“Mr. Toretto”) and Daniel C. King (“Mr. King”) (collectively “Plaintiffs”) filed this suit as a putative class action. The Defendant is Mediant Communications, Inc. (“Defendant”), a Delaware corporation that is employed by companies and mutual funds to distribute materials to shareholders and coordinate shareholder voting. Plaintiffs’ claims stem from a data breach that occurred in April 2019, during which hackers accessed Mediant’s business email accounts and stole the personal information of thousands of shareholders, including individuals’ names, genders, physical addresses, email addresses, phone numbers, Social Security Numbers, tax identification numbers, account numbers, and various other…
