12 Plaintiff Richard Ortiz moves for summary judgment to reverse the Commissioner of the 13 Social Security Administration’s (the “Commissioner’s”) final administrative decision, which found 14 Ortiz not disabled and therefore denied his application for benefits under Title II of the Social 15 Security Act, 42 U.S.C. § 401 et seq. The Commissioner cross-moves to affirm. For the reasons 16 stated below, the court grants Ortiz’s motion, denies the Commissioner’s cross motion, and remands 17 this case for further proceedings. 18 I.
