13 14 Plaintiff, Andrew Ashiegbu, seeks judicial review of an administrative law judge (“ALJ”) 15 decision denying his application for supplemental security income under Title XVI of the Social 16 Security Act. Plaintiff’s request for review of the ALJ’s unfavorable decision was denied by the 17 Appeals Council, thus, the ALJ’s decision is the “final decision” of the Commissioner of Social 18 Security which this court may review. See 42 U.S.C. §§ 405(g), 1383(c)(3). Both parties have 19 consented to the jurisdiction of a magistrate judge (dkts. 9 & 11), and both parties have moved for 20 summary judgment (dkts. 23, 25 & 26). For the reasons stated below, the court will grant 21 Plaintiff’s amended motion for summary judgment (dkt. 26), and will deny Defendant’s motion 22 for summary judgment (dkt. 25). 23 …
