11 Defendant. 12 13 Pending before the Court is Defendant Novartis Pharmaceuticals Corporation’s motion to 14 exclude the testimony of Plaintiff Plexxikon Inc.’s expert Dr. Michael L. Metzker. See Dkt. No. 15 200. The Court held a hearing on November 1, 2019. Dkt. No. 337. For the reasons detailed 16 below, the Court DENIES the motion. 17 I. BACKGROUND 18 Issues of patent invalidity and infringement are determined from the perspective of a 19 person of ordinary skill in the art (“POSITA”) in the field of the claimed invention. See, e.g., 20 Sundance, Inc. v. DeMonte Fabricating Ltd., 550 F.3d 1356, 1361, n.3 (Fed. Cir. 2008).
