13 Pursuant to Rule 12(f) of the Federal Rules of Civil Procedure, Plaintiff Joel Goobich 14 moves to strike Defendant Excelligence Learning Corporation’s Affirmative Defense Nos. 1 15 through 16, 25, 26, 35, and 41 asserted in Defendant’s Answer (Dkt. No. 12). The Court takes the 16 matter under submission for decision without oral argument pursuant to Civil Local Rule 7-1(b). 17 For the reasons below, Plaintiff’s motion is GRANTED with leave to amend. 18 I.
